Cancellation & Refund Policy

CANCELLATION BY KASHMIRTREKKINGS.COM ONLINE DIVISION OF ROYAL INDIA EXPEDITION

KashmirTrekkings.Com Online Division of Royal India Expedition reserves the right to cancel a departure and will advise you of such cancellations no later than 7 days before the tour departure date. If due to ‘Force Majeure’, KashmirTrekkings.Com Online Division of Royal India Expedition reserves the right to cancel a departure at any time. With any form of cancellation, KashmirTrekkings.Com Online Division of Royal India Expedition will offer you alternative Treks/tours, and if the price of your alternative booking is of lower value than the original booking we will refund the difference to you. If you do not accept alternative arrangements we will refund all payments after deducting our cost incurred in advance booking. KashmirTrekkings.Com Online Division of Royal India Expedition will not be liable for any additional costs incurred by you.

KashmirTrekkings.Com Online Division of Royal India Expedition will not be liable for any delay in, change to or cancellation of trips due to ‘Force Majeure’. ‘Force Majeure’ means a circumstance beyond the reasonable control of KashmirTrekkings.Com Online Division of Royal India Expedition and includes, but is not limited to, war or threat of war, riot, civil strife, terrorist activity, industrial dispute, disease, industrial or nuclear disaster, adverse weather conditions, fire and strikes.

 

CANCELLATION BY YOU

If you wish to cancel all or any part of your booking, notification of cancellation must be made to KashmirTrekkings.Com Online Division of Royal India Expedition in writing/E-mail. The date of the cancellation is the date on which KashmirTrekkings.Com Online Division of Royal India Expedition receives notification by email or in writing. Days before departure charge applicable as follows, per person:

Up to 24 Days: – 90% of Trek/Tour cost will be refunded.

Between 14-24 Day: – 60% of Trek/Tour cost will be refunded.

Between 14-08 Days: – 40% of Trek/Tour cost will be refunded.

Less than 7 Days: – No refund

Please Note: GST, Payment Gateway Charges etc will not be refunded in any case.

CHANGES TO YOUR HOLIDAY

You acknowledge that travelling with KashmirTrekkings.Com Online Division of Royal India Expedition requires a degree of flexibility, good humour, and an understanding that the itinerary, accommodation, and/or modes of transport may change, even after a tour’s commencement, without prior notice due to local circumstances. Changes may occur because of ‘Force Majeure’, poor road conditions, weather, the availability of tickets, vehicle breakdowns, changes in transport schedules, or other circumstances beyond RIE/THT control or which simply cannot be foreseen. KashmirTrekkings.Com Online Division of Royal India Expedition does not accept any responsibility for loss of enjoyment, delays or compensation resulting from circumstances beyond RIE/THT control. You acknowledge that group sizes may also vary during the duration of your tour.

The information about trips is subject to change. It is your responsibility to review the up-to-date Trip Notes and Pre-Departure Information. These can be obtained from KashmirTrekkings.Com Online Division of Royal India Expedition website. The information and conditions in the Trip Notes and Pre-Departure Information are deemed to be part of the contract. Where changes to your trip occur after you have received your final documentation we will, where practical, advise you of such changes. In case of evacuation the cost of the evacuation will be borne by the participant not by KashmirTrekkings.Com Online Division of Royal India Expedition. Any extra boarding, lodging etc due to the evacuation will be borne by the participant.

AUTHORITY OF THE LEADER

At all times the decision of the RIE/THT Tour/Trek leader or representative will be final on all matters likely to affect the safety and well-being of the trip. This includes any decision that the RIE/THT Leader makes about your on-going participation in the trip or certain activities that comprise part of the trip.  If you fail to comply with a decision made by a RIE/THT Leader, or interfere with the well-being of the group, then the RIE/THT Leader reserves the right to terminate this contract and order you to leave the tour immediately, with no right of refund.

Circumstances beyond Our Control: 
We cannot pay any compensation, reimburse expenses, or cover losses for any amount or otherwise accept responsibility, if as a result of circumstances beyond our control, we have to change your Holiday after booking, or we, cannot supply your Holiday, as we had agreed, or you suffer any loss or damage of any description. When we refer to circumstances beyond our control, we mean any event that we could not foresee or avoid, even after taking all reasonable care. Such circumstances will usually include, but are not limited to, war, threat of war, airport closures, epidemic, natural or nuclear disaster, terrorist activity, civil unrest, industrial dispute, bad weather.

Your Responsibility:
We want all our customers to have an enjoyable, carefree Holiday. But you must remember that you are responsible for your actions and the effect they may have on others. If we, or another person in authority, believe your actions could upset, annoy or disturb other customers or our own staff, or put them in any risk or danger, or damage property or you are unfit to travel, we may end your Holiday and terminate your contract. You and your travelling party will be prevented from using your booked accommodation, transport, and any other Travel Arrangements forming part of your booking and we will not be liable for any refund, compensation or any other costs you have to pay. Alternatively at our discretion, you may be permitted to continue with your Holiday but may have additional terms of carriage imposed upon you.

In addition to the above and the effect your actions may have on others, you must particularly also bear in mind that you are responsible for your safety, and that you are responsible for the condition of the property you occupy. We are not responsible for any accidents which occur in or around irresponsible behaviour, or for any accidents which occur anywhere on properties because of glass, china or the like which you have broken and/or have left in a way in which injury can result.

We expect that you will enjoy your holiday with us. We appreciate that you may well drink alcohol as part of your enjoyment. You must, however, do so responsibly and we will have no liability to you for any injury, loss or damage you suffer as a result of your judgment being impaired wholly or partly by alcohol.

We will hold you and the members of your travelling party jointly and individually liable for any damage to the accommodation, furniture, apparatus or other materials located within the accommodation, together with any legal costs we incur in pursuing a claim. It is your duty to report any breakages, defects or damage to an appropriate person immediately.

If You Have A Complaint:
We aim to provide the best Holiday possible. However, if you are not satisfied please complain as soon as possible to the relevant person (for example, the accommodation management or transport supplier). If they cannot help, you must tell your Holiday Representative and we will do everything reasonably possible to sort the problem out. No complaints or refund for the same be entertained after the Holiday programs. All disputes shall be subject to jurisdiction of Srinagar courts only.
